Is there a possibility that the RBS is paying PPI to their customers. My husband and I were on a trust deed and were told we had around 5000 in PPI but did not receive it as they would offset it to what we owed. We have now been released for 3 years.

I have been out my trust deed for over 12 yeqrs but RBS took the decision to offser the ppi i was owed by them.
In a similar case rbs lost a court hearing about offsetting however rbs are going back to court around this issue.
If you havent claimed already i would claim before ppi deadline

The trust deed company made us do it with a claims company as we were still on the trust deed. That's when we found out. It's not fair if they keep the money as we paid our debts and at the end of the day we were still mis sold.

OK - well if they received 100% of what was owed to them (before the trust deed began) they'll have nothing to set-off any PPI against.

Understood.

I was referring to the amount owed to them before the trust deed began.

If you owed them 5000 before the trust deed began, and they received 5000 from your trust deed, then they have nothing to set-off against.

If they received less than 5000 from your trust deed, their position is that they can set-off PPI against the debt that wasn't repaid to them via your trust deed.

The amount owed before the trust deed was greater. The 5000 was roughly amount of PPI we had.

So as it stands they'll look to set-off the PPI money against the part of your debt they did not receive back from your trust deed.

This may or may not turn out to be sustainable in the long-term.
