MAP Sequestration

From 1st April 2015 Scottish bankruptcy, otherwise known as sequestration, is subject to new rules and procedures. The Minimal Assets Process (MAP) is potentially a new route to bankruptcy for those individuals with limited incomes and few assets.

Minimal Assets Process Sequestration Qualification Criteria

To qualify for the MAP route to sequestration you must:

  • Owe at least £1,500 and no more than £17,000.

  • Live in Scotland (or have lived here at some point during the past year).

  • Not have been bankrupt previously in Scotland during the past five years.

  • Be able to pay the £90 application fee.

  • Have been on benefits for the past six months, or be assessed as having no surplus income from which to pay a Debtor Contribution Order.

  • Not own any land or property.

  • Not own a single asset worth more than £1,000 (other than a vehicle).

  • Not own total assets worth more than £2,000.

  • Not own a vehicle worth more than £3,000. Keeping a vehicle worth less than this amount will also depend on their being a reasonable need to operate it.     

  • Have obtained advice from an “approved money adviser” before applying. 

Getting Advice on the MAP Route to Bankruptcy

To access the MAP route to sequestration you must first receive advice from an approved money adviser. You may be able to access this advice by contacting:

  • Your local authority money advice team.
